Welcome to Worthit! By using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website.

These Terms and Conditions ("Agreement") are entered into by and between Worthit, a company registered and operating under the laws of [State of Texas], and you, the user, whether an individual or entity, who accesses and uses our website located at Worthit and the services provided therein.

1. Acceptance of Terms

By shipping your jewelry to Worthit, you agree to send your jewelry by mail to Worthit for appraisal and to have it submitted to auction for potential sale. You also agree to the following terms:

  • Appraisal and Auction Process: Once Worthit receives your jewelry, we will appraise the items to determine their estimated value. Based on this appraisal, we may submit your jewelry to an auction for sale. The sale price will be determined by the auction process, and Worthit is not responsible if the final sale price does not meet your expectations or the price you were hoping for.

  • Payment for Sale: If your jewelry is sold at auction, Worthit will send payment for the sale price to the account information you provide. It is your responsibility to ensure that the account details you provide to us are accurate and complete. Worthit will not be held responsible for any failure to receive payment due to incorrect or incomplete account information. If the account information you provide is incorrect, we are not liable for any lost payments, and you may be required to correct the details and resubmit them before we can process any payments.

  • No Guarantee of Sale: Worthit makes no guarantee that your jewelry will be sold or that it will sell for any specific price. The auction process is subject to factors beyond our control, and pricing is ultimately determined by market demand and the auction's participants.

  • Non-Responsibility for Sale Price: Since the items are sold through an auction, Worthit is not liable if your jewelry does not sell at the price you desire or at all.

By agreeing to these terms, you acknowledge and consent to the auction process and the potential variability in the sale price of your jewelry.

2. Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be posted on this page with an updated "Effective Date". Your continued use of the Website and Services after such changes have been posted will constitute your acceptance of the modified terms.

3. Account Registration

To access certain features of the Website or Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you believe your account has been compromised, you must notify us immediately.

4. Use of Services

You agree to use the Website and Services solely for lawful purposes and in accordance with these Terms. You are prohibited from using the Website or Services in any manner that could:

  • Violate any applicable law, regulation, or third-party right.

  • Infringe upon the intellectual property rights of Worthit or any third party.

  • Disrupt, interfere with, or harm the functionality of the Website or Services.

  • Engage in fraudulent or misleading activities, including but not limited to misrepresentation of your identity or personal information.

5. Sale of Jewelry and Cancellation Policy

By shipping your jewelry to Worthit, you agree to sell your item to us under the terms outlined in this Agreement. However, you may cancel the sale process at any time before we make a final offer by contacting us via email at worthitjewel@gmail.com. Please note that if you cancel the sale after sending us your jewelry, a $55 cancellation fee will apply. This fee covers the shipping and handling costs incurred by Worthit.

If you choose to cancel after shipping your item but before the sale is finalized, the item will be returned to you, and the cancellation fee will be deducted from any refund. Shipping is insured by fedex. 

6. Insurance Coverage for Jewelry

Once you ship your jewelry to Worthit, it is covered by insurance for loss, theft, or damage during the shipping process. You must use our shipping label in order to be covered under the insurance through the carrier. If our shipping label is not used your item will not be insured. This coverage begins once the item is received by Worthit and is valid until a final decision is made on the sale of your item.

In the event that your jewelry is lost, stolen, or damaged, please contact us immediately at worthitjewel@gmail.com to initiate a claim. We will work with you to resolve the matter and ensure you are appropriately compensated in accordance with our insurance policy. 

7. Intellectual Property

All content, designs, logos, trademarks, and other intellectual property related to the Website and Services are the property of Worthit or its licensors. You agree not to copy, reproduce, distribute, or create derivative works of any content or intellectual property without prior written consent from Worthit.

8. Payment Terms

If you make a purchase through the Website or Services, you agree to provide accurate payment information and authorize Worthit to charge the applicable fees to your chosen payment method. All payments are subject to our Payment Terms (if applicable) and any additional terms associated with a specific transaction.

9. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Attempt to gain unauthorized access to the Website, Services, or any related systems or networks.

  • Engage in spamming, phishing, or other forms of unauthorized solicitation.

  • Upload, transmit, or distribute any harmful code (e.g., viruses, malware).

  • Use the Website or Services for any illegal, harmful, or unethical purposes.

10. Termination of Access

Worthit reserves the right, in its sole discretion, to suspend or terminate your access to the Website and Services at any time and for any reason, including but not limited to a violation of these Terms and Conditions. Upon termination, you must cease all use of the Website and Services.

11. Limitation of Liability

To the fullest extent permitted by law, Worthit will not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Website or Services. Our liability shall be limited to the amount you paid for the specific service or product that gave rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Worthit, its affiliates, officers, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Your use of the Website and Services.

  • Your violation of these Terms and Conditions.

  • Your violation of any third-party rights or applicable law.

13. Privacy and Data Collection

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. 15. Arbitration Clause

Arbitration Process:

  • The arbitration shall be conducted by a single neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA).

  • The arbitration will take place in [City, Texas], unless the parties agree otherwise in writing.

  • The arbitrator’s decision shall be final and binding upon both parties, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

Exceptions:

  • You and Worthit may pursue claims in small claims court if they meet the requirements of such a court and remain within its jurisdiction.

  • You may also choose to opt out of this arbitration agreement within 30 days of your initial use of the Website by sending an email to worthitjewel@gmail.com expressing your decision to opt out of the arbitration clause.

By agreeing to these Terms and Conditions, you acknowledge that you are waiving your right to file a lawsuit in court or participate in a class action related to any disputes covered by this arbitration agreement.

16. Disclaimer of Warranties

The Website and Services are provided on an "as-is" and "as-available" basis. Worthit makes no representations or warranties regarding the functionality, reliability, or availability of the Website or Services. We disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full effect. The invalid or unenforceable provision will be modified to reflect the intent of the parties as closely as possible.

18. Entire Agreement

These Terms and Conditions, along with our Privacy Policy and any other legal notices or agreements published by Worthit on the Website, constitute the entire agreement between you and Worthit regarding the use of the Website and Services.
